INFORMATION CLAUSE FOR CONTRACTORS

Pursuant to Article 13 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as RODO, I would like to inform you that the controller of your personal data is SEVITEL Ltd. with its registered office in Katowice, 29 Leopolda St. tel. 32 705 73 01. Your personal data will be processed for at least one of the following purposes:

1) for the performance of a contract to which you are a party, e.g. delivery or collection of ordered products, provision of services, acceptance or submission of a service request or complaint, and to take action, at your request, before concluding a contract, e.g. presentation of an offer or acceptance of an order, conducting negotiations (legal basis: Article 6(1)(b) RODO),

2) for the fulfillment of the administrator’s legal obligations (legal basis: Article 6(1)(c) RODO), including the maintenance of accounting books and records specified by tax law, settlement and payment of taxes, in particular VAT and income tax, conducting reporting specified by law,

3) for the purposes arising from the legitimate interests pursued by the administrator (legal basis: Article 6(1)(f) RODO), consisting in:

  • presenting information about the products or services offered by the administrator and obtaining opinions about these products or services,
  • carrying out orders or orders,
  • purchasing products or services by the administrator,
  • execution and service of contracts concluded by the administrator,
  • steeling, asserting or defending claims,
  • creation of compilations, analyses and statistics for the administrator’s internal needs.

Personal data may be transferred to the following categories of data recipients:

  • entities processing personal data on behalf of the administrator, including those providing consulting, advisory, accounting services for the administrator, entities bidding jointly with the administrator for the award of contracts or subcontractors of the administrator,
  • entities providing legal assistance, auditing companies,
  • organizers of tenders and other proceedings in which the administrator applies for the award of contracts,
  • entities for which the administrator executes orders (including providing services, delivering products),
  • providers of postal and courier services,
  • entities and authorities authorized to request data under applicable laws, e.g., mining authorities, judicial authorities,
  • banks, processing contractual payments.

Your personal data will be stored until the date of execution of the contract, or until the expiration of the statute of limitations for civil law claims, or the period in which the administrator is required by law to store data, or the period in which the administrator may incur the legal consequences of non-performance or improper performance of its obligations, or the duration of proceedings initiated in this regard.

The data you provide will not be used by the controller for automated decision-making, including profiling as referred to in Article 22 of the RODO Regulation. The controller informs you of your right to request access to your data, correction (rectification), deletion, restriction of processing, data portability.

You may also object to the processing of personal data concerning you under Article 6(1)(f) of the RODO. The law defines the scope of these rights and the cases in which you can exercise them. The Administrator will consider the legitimacy of your request or objection and respond to it in accordance with the law.

You may also file a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates the law. Provision of personal data is necessary for the conclusion and performance of the contract. Laws may require the provision of data for the purposes described therein (e.g. taxation). Provision of data is therefore mandatory, since without it it will not be possible to conclude and perform the contract and legal obligations incumbent on the controller.

Pursuant to Article 14 of Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation), hereinafter referred to as RODO, I would like to inform you that the controller of your personal data is SEVITEL Ltd. with its headquarters in Katowice, 29 Leopolda Street tel. 32 705 73 01.

The Administrator has obtained your personal data (name, surname, position held, business phone number, business e-mail address) from your employer or from another entity in which you are employed or with which you cooperate on a legal basis other than an employment contract (hereinafter referred to collectively as the Employer).

Personal data will be processed for purposes arising from the legitimate interests pursued by the administrator (legal basis: Article 6(1)(f) RODO), consisting of:

  • conducting correspondence concerning the activities carried out by the administrator or your Employer,
  • taking actions aimed at concluding an agreement between the administrator and your Employer, including submitting offers or orders, conducting negotiations,
  • performing contracts to which your Employer is a party, such as the delivery or receipt of products, providing services, receiving or reporting and handling complaints or service requests,
  • presenting information about products or services offered by the administrator and obtaining opinions about these products or services,
  • handling contracts concluded by the administrator,
  • sending accounting documents,
  • execution of orders or orders,
  • purchasing products or services by the administrator,
  • establishing, asserting or defending claims,
  • creating compilations, analyses and statistics for the administrator’s internal needs.

Personal data may be transferred to the following categories of data recipients:

  • entities that process personal data on behalf of the controller, e.g. those that provide consulting, advisory, accounting services for the controller,
  • entities providing legal assistance, auditing companies,
  • providers of postal and courier services,
  • entities and authorities authorized to request data under applicable laws.

Your personal data will be kept until the date of execution of the contract with your Employer or the expiration of the statute of limitations for civil law claims or the period in which the administrator is required by law to keep the data or the period in which the administrator may incur legal consequences of non-performance or improper performance of obligations incumbent on it, or the duration of proceedings initiated in this regard.

The data you provide will not be used by the controller for automated decision-making, including profiling as referred to in Article 22 of the RODO Regulation.

The controller informs you about the right to request access to your data, correction (rectification), deletion, restriction of processing, data portability. You may also object to the processing of personal data concerning you under Article 6(1)(f) of the RODO Regulation. The law defines the scope of the above rights and the cases in which you can exercise them. The Administrator will consider the legitimacy of your request or objection and respond to it in accordance with the law.

You may also file a complaint with the President of the Office for Personal Data Protection if you believe that the processing of your personal data violates the law.

Provision of personal data is voluntary, but without it it will not be possible to contact and fulfill the purposes of the administrator and your Employer specified above.
